GIFT CARD TERMS AND CONDITIONS

The following terms and conditions (the “Terms and Conditions”) apply to any Vaunt Fitness LLC card originally purchased at any participating Vaunt Fitness LLC (“Vaunt Fitness”) or on the VauntFitness.com website (the “Vaunt Fitness Gift Card”).  By purchasing a Vaunt Fitness Gift Card, accepting and retaining a Vaunt Fitness Gift Card or using a Vaunt Fitness Gift Card, you agree to these Terms and Conditions. Vaunt Fitness reserves the right to change, amend or terminate the Terms and Conditions of the Vaunt Fitness Gift Card program at any time with or without notice in our sole discretion.

USE OF THE VAUNT FITNESS GIFT CARD

You may use the Vaunt Fitness Gift Card only to purchase eligible merchandise and pay for services at our Vaunt Fitness Fitness Club (excluding cafes), The Spa and The Shop.

REDEMPTIONS/BALANCES

Your use of the Vaunt Fitness Gift Card is limited to the current dollar value held on the card. You may obtain your balance by presenting your Vaunt Fitness Gift Card at our Vaunt Fitness Club. Vaunt Fitness Gift Cards may not be redeemed for cash, except to the extent required by law.

RESTRICTIONS

You may not return, resell or use any Vaunt Fitness Gift Card for any unauthorized advertising, marketing, sweepstakes or other promotional purposes.

NO EXPIRATION DATE/SERVICE CHARGES

The Vaunt Fitness Gift Card has no expiration date, service charges or dormancy fees.

PROMOTIONAL CARDS

These Terms and Conditions do not apply to gift cards or other stored value cards that are given away for free or distributed as a reward, incentive, or as part of a marketing or promotional program (“Promotional Cards”). Promotional Cards may have different terms and expiration dates to the extent permitted by applicable law.

LOST OR STOLEN CARDS

Protect your Vaunt Fitness Gift Card as if it were cash and safeguard the Vaunt Fitness Gift Card from unauthorized use. Except where required by applicable law, neither Issuer nor Vaunt Fitness is responsible for and will not replace Vaunt Fitness Gift Cards if lost, stolen, damaged or destroyed.

MISUSE OF THE CARD

Issuer and/or Vaunt Fitness reserves the right in its discretion to suspend or terminate use of any Vaunt Fitness Gift Card if Issuer or Vaunt Fitness suspects any fraud or misuse of an Vaunt Fitness Gift Card. Issuer or Vaunt Fitness may cancel the Vaunt Fitness Gift Card at any time, without notice.

PROPERTY RIGHTS

The consideration paid for the Vaunt Fitness Gift Card, including any unredeemed balances, is the property of the Issuer.

NO WARRANTIES

Subject to applicable law, Vaunt Fitness and Issuer make no warranties, express or implied, with respect to the Vaunt Fitness Gift Cards, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. Neither Issuer nor Vaunt assume any responsibility for any loss of any kind arising out of your use of any Vaunt Fitness Gift Card. In the event an Vaunt Fitness Gift Card is not functional, your sole remedy and Issuer’s and Vaunt Fitness’ sole liability shall be the replacement of the Vaunt Fitness Gift Card at its then-current value.

GOVERNING LAW

The laws of the Commonwealth of Illinois govern the Card and the Terms and Conditions of this Agreement, without regard to choice of law principles.

SEVERABILITY

If any one or more of the provisions of these Terms & Conditions shall be for any reason whatsoever held invalid, then such provisions shall be deemed severable from the remaining provisions and shall in no way affect the validity or enforceability of the other provisions of these Terms & Conditions.

ENTIRE AGREEMENT

Except as specifically stated otherwise, these Terms & Conditions set forth the entire understanding relating to the subject matter hereof, and all prior understandings, written or oral, are superseded by these Terms & Conditions.
